Resolutions from the 'Registro Nacional' 1884-6 Line breaks have been inserted in the Spanish to make the meaning clearer, but no other changes have been made. I have then tried to translate the meaning into clear English, but refer serious scholars to the original Spanish for precision. Decree commanding that the Department of Engineers formulates in agreement with Messrs. Luis Jones and company a contract for the proposed exploitation (operation?) and construction of a railway between the town of the Chubut and the port 'Bahia Nueva'. Luis Jones y Cia. la construcción y explotación de un Ferro-Carril entre el pueblo del "Chubut" y el puerto "Bahia Nueva" y un muelle para carga y descarga en este último punto; y siendo conveniente proceder á la ejecución de esa obra que facilitará la salida de los productos de la Colonia y disminuirá los fletes, fomentando el progreso de ese centro de población; - El Presidente de la República. -Decreta: -
Department of the Interior. - Buenos Aires, January 21 1885. - In view of the authorization conferred by the law of 22 October 1884, to contract with Messrs. Lewis Jones and Company for the construction and operation of a railway between the town of 'Chubut' and the port 'Bahia Nueva', and a wharf for loading and unloading at this latter point; and being advisable to precede to the execution of that work that will facilitate the export of products of the colony and will diminish the freight charges, encouraging the progress of that centre of population; - the President of the Republic. - He decrees: - Art. 1o El Departamento de Ingenieros formulará de acuerdo con los proponentes un proyecto de contrato para la ejecución de esas obras que debera someter á la aprobación del P. E.-
Article 1 The Department of Engineers will formulate in agreement with the promoters a proposed contract for the execution of those works that must be approved by the P. E. - Art.2o Los estudios para la via y el muelle, los planos generales y de detalle, las especificaciones determinando la clase de materiales, número de estaciones, tren rodante y el pliego de condiciones para la construcción de dichas obras serán presentados por los interesados al Departamento de Ingenieros para la aprobación que corresponde autes de comenzar los trabajos. -
Article 2 The studies for the line and the wharf, with plans both general and in detail, the specifications determining the class of materials, number of stations, rolling stock and the schedule of conditions for the construction of these works will be presented by the interested parties at the Department of Engineers for the approval that will permit the beginning of the works - Art.3o La Empresa sólo gozará de los beneficios acordados en los articulos 2o a 4a de la ley de concesión. -
Article 3 The Company will only enjoy the benefits set out in articles 2o to 4a of the concession law - Art. 4o El plazo para comenzar y terminar los trabajos será el determinado en el art. 3o de la ley, pudiendo ser prorrogado por causas justificiados. -
Article 4 The specified time for beginning and completing the works will be the specified one in article 3. of the law, being able to be extended by justifiable causes. - Art. 5o Se establecerá en el contrato, las tarifas para el muelle y Ferro-Carril, la intervención que en ellos corresponda al P. Gobierno Nacional de la Republica Argentina por una parte, y por otra los Sres. Luis Jones y Ca. han celebrado el siguiente. - Contrato: -
The Minister of the Interior, representing the most excellent national government of the Republic of Argentina on the one hand, and on the other Messrs. Luis Jones and Co., have formally agreed the following - Contract: Art. 1o De acuerdo con lo dispuesto por la Ley no 1539, de 22 de Octobre de 1884, el P. E. cencede á los Sres. Luis jones y Ca. autorización para construir y explotar un ferro carril entre el pueblo del "Chubut" y el puerto "Bahia Nueva" y un muelle para carga y descarga en este último punte. -
Article 1. In agreement with the provisions of Law no. 1539, of 22 October 1884, the 'P.E.' (Civil Service? Minister?) grants to Messrs. Luis Jones and Co. authorization to construct and to operate a railway between the town of the Chubut and the port 'Bahia Nueva', and a wharf to load and unload at this latter point. - - Art. 2o El ancho ó trocha del camino será de un metro, ó sea igual á la del F. C. de Córdoba á Tucuman. --
Article 2. The width or gauge of the track will be one metre, or equal to the gauge of the railway from Córdoba to Tucuman. -- Art. 3o Una vez abierto el F. C. al servicio publíco, el P. E. cederá en propiedad á la empresa un área de tierra de cinco kilómetros de fondo á cada lado de la via (fuera de las destinados para la colonia) donde haya tierras fiscales. -
Article 3. Once the railway has been opened to public service, the 'P.E.' will grant ownership to the company a land area five kilometres deep on each side of the route (outside the designated area for the colony) where there are government or state lands.- Art. 4o Los señores Luis Jones y Cia. presenterán los estudios técnicos de la via, á la aprobacion del P. E. en el término que fija el art. 3o de la Ley no. 1539 para principiar los trabajos. - El estudio técnico comprenderá la traza del camino, los perfiles y descripciones de la via permanente; numero, extensión y caráctar de las obras de arte y muelle, y composición de las Estaciones, talleres, depósitos y accesorios correspondientes. Todo en términos suficientes para determinar la importancia de las Obras. Los estudios y planos serán presentados por duplicado á fin de que se conserve un ejemplar de los proyectos aprobados, en el Departamento de Ingenieros. -
Article 4. Messrs. Luis Jones and Co. will present technical studies of the route, for the approval of the 'P. E.' and within the period that Article 3 of Law no. 1539 fixes to begin the works; the technical study will comprise the plan of the route, the profiles and descriptions of permanent way; the number, size and nature of engineering works and wharfs, and the corresponding composition of the stations, workshops, warehouses and accessories. Everything will be in sufficient detail to determine the importance of the works. The studies and plans will be presented in duplicate, one of which, showing the approved projects, will be preserved in the Department of Engineers. Art. 5o Los señores Luis Jones y Ca. se obligan á comenzar y terminar los trabajos en el plazo determinado en el art. 3o de la Ley. pudiendo ser prorogado por causas justificados. -
Article 5. Messrs. Luis Jones and Co.commit themselves to begin and to finish the works in the time specified in Article 3 of the law, with extension being possible for good reasons. - Art. 6o En el pliego de condiciones que decrete el Gobierno, se fijará. de acuerdo con los señores Jones y Ca. el sistema de via permanente á emplearse siendo los rieles de acero; la dotación del tren rodante, su clase, peso y fuerza; los edificios y accesorios, especificándose la clase de materiels y sistema de construcción del muelle, pescante para el servicio de carga etc. El numero de Estaciones será por lo menos, de tres, isiendo dos de ellas terminales y una intermedia. -
Article 6. In the schedule of conditions that the Government decrees, will be specified, in agreement with Messrs. Jones and Co. the permanent way system to be used, being the rails of accro(weight of rail?) the nature of the rolling stock, its class, weight and carrying capacity; the buildings and accessories, specifying the type of materials and system of construction of the wharf, crane for the service of loading etc. The number of Stations will be at least three, there being two terminals and one intermediate one. Art. 7o Las tarifas serán fijadas de acuerdo con el Poder Ejecutivo y en ningun caso, mayores que la siguiente:

Article 8. The Company will be able to receive by the use of the wharf for the ships that berth alongside, a tax in the following form: - 1 Not paying wharf duty, boats of less than five tons, and those being the property of the State. 2 Paying four centavos national currency per day, by ton of registry, boats of less than one hundred tons, and larger vessels will pay in addition a cent for each ton that exceeds one hundred. 3 It is understood that the boats that do not berth at the wharf and which therefore do not make use of this facility, will not pay the wharf duty. - 4 The tariff set out in section 2 of this Article is the maximum that will be established, and the government will be able to reduce it when the net profit of the operation of the wharf exceeds eight percent of the used capital - Art. 9o La Compañia no podrá cobrar mas de cincuenta centavos moneda nacional por tonelada de mil kilógramos de carga y descarga, siempre que los bultos sean de menos de una tonelada de peso y que no sea necesario usar pescante. -
Article 9. The Company will only be able to receive fifty cents national currency per ton (of thousand kg.) of loading and unloading, whenever the individual packeges are of less than one ton of weight and that it is not necessary to use a crane. - Art. 10. Article 11. Loads on behalf of the State will have priority over those of the public, this includes military equipment or materials for public works, and they will pay half tariff for military stores and three-quarters for public works materials. Art. 12. Los pasageros y sus equipages podrán transitar libremente en la parte del muelle destinada para este servicio, salvo el caso en que tengan que usar de los pescantes, wagones y zorras -
Article 12. Passengers and their luggage will be able to trans-ship without charge in the part of the wharf intended for this service, except in the case of them making use of the cranes, wagons and (barrows or trollies?). - Art 3o(sic) Los pasageros no estan obligados á entregar sus equipages, para que sean transportados por la compañia concesionaria ó cualquiera otra que se establezea, pudiendo valerse de los medios que encuentren más convenientes o económicos.
Article 3(sic) Passengers will not be under any obligation to give up their luggage, para que sean transportados for the concessionary company or any other which may be established, pudiendo valerse de los medios which are found more convenient or economic. Art. 14. En caso que los concesionarios no presenten los planos y proyectos en el plazo fijado en este contrata, ó no diesen principio á las obras, podrá el Poder Ejecutivo dejar sin efecto esta concesión. -
Article 14. In case the concessionaires do not present the plans and proposals during the period allowed for in this contract, or have not put in hand or started the works, the 'P. E.' will be able to lapse this concession. - Art. 15. El Poder Ejecutivo hará inspeccionar por sus ingenieros siempre que lo crea conveniente, tanto en construcción como en explotación a la via férrea, ---
Article 15. The 'P. E.' will inspect by its engineers whenever it thinks advisable, in construction as in operation of the railway.- Art. 16. La empresa rebajará un 50 por ciento en los pasages expedidos por el Gobierno á los empleados en comisión y en los fletes de toda carga que perteneza á la Nación. -
Article 16. The company will rebate 50% on journeys arranged by the government for its employees in commission, and of the freight charges (that are the responsibility of) the nation - Art. 17. El domicilio legal de la compañia, será en la República donde tendrá asiento y residencia efectiva un representante de ella con plenas facultades para tratar directa y definitivamente y arreglar todas las dificultades que pudieran suscitarse con el Gobierno ó con los particulares. - La contabilidad se llevará en idioma nacional y se harán efectivos en la República los dividendos de las acciones que en ella se suscriban. -
Article 17. The company shall be legally constituted in Argentina where it will have its head office and a representative with full authority to deal with the government or individuals. Business shall be conducted in the national language and share dividends shall be payable in the republic. - Art 18. Todos los actos y contratos de la compañia concesionaria serán sometidos á las leyes de la Republica, asi como á la jurisdicción de sus tribunales, sin que pueda sustraerse á ellos por ningún motivo. -
Article 18. All the acts and contracts of the concessionary company will be put under the laws of the republic, likewise the jurisdiction of their courts, without exception. Art. 19. La empresa tendrá la obligación de poblar las tierras cedidas introduciendo dentro de los cinco primeros anos de la explotación un capital en haciendas y población por valor de cien pesos por cada dos mil quinientas hectáreas, sin perjuicio de poder enagenar total ó parcialmente el terreno, siempre que el nuevo adquirente cumpla la obligación expresada. - - Si la empresa no cumpliesa la obligación de poblar dentro del término fijado, el Poder Ejecutivo podrá recuperar la propiedad de las tierras que no hayan sido pobladas. -
Article 19. The company will have the obligation to populate granted lands, introducing within the first five years of operation a capital in livestock and population of the value of one hundred pesos for each 2500 hectares, without risk of losing all or part of the land, whenever the new purchaser fulfills the obligation expressed - - If the company does not comply with the obligation to populate within the fixed term, the Executive Power will be able to recover the property of the lands that have not been populated - Art. 20. La empresa ó sucesores en el dominio no podrán oponerse en ningun tiempo á que se abran caminos y calles en los terrenos cedidos cuando el incremento de la población lo exija, ni á que sean cruzadas por ferro-carriles, y no tendrán derecho á indemnización por las superficies que se ocuparen en los casos indicados. Solo podrán exigir por las constructiones que hubieren en la parte que ocupasen los caminos. -
Article 20. The company, or its successors in its field, will not be able to oppose at any time the routes and roads which are opened in the ceded lands when the increase of the population demands it, nor any that cross railways, and does not have the right of compensation for the areas (surfaces?) that will be occupied (?) in these cases. They will only be able to seek compensation for structures which were in what has become a road. - Art. 21. Para la construcción del camino y del muelle, asi como para la explotación en su caso, la empresa queda obligada al estricto cumplimiento de lo que prescriben las leyes, decretos y reglamentos sobre Obras Públicas, de Contabilidad y de Ferro-Carriles en vigencia, ó que en adelanto se dictaren; asi como a los reglamentos y leyes relativos á muelles y puentes. - ; Gozan en cambio de todos las privilegios que consigua la Ley de Ferro-Carriles. -
Article 21. For the construction of the track and the wharf, as for their operation, the company is obliged strictly to observe the laws, decrees and regulations on public works, on accounting and on railways in use, and those that will be passed; also as to the regulations and laws relating to wharves and bridges - They enjoy however all the privileges that are contained in the Law of Railways - Art. 22. La empresa no podrá hacer transferancia de esta concesión sin la aprobación del Poder Ejecutivo. - Luis Jones y Ca.
Article 22. The company will not be able to transfer this concession without the approval of the 'P. E.'- Luis Jones and Co.
